Representative Cases:
New York X-Ray Pathological Laboratory, Inc. V. U.S. Immigration and Naturalization Service, 523 F. 2d 79 (2nd Cir 1975). The firm’s experience in dealing with the U.S. Immigration and Naturalization Service (now known as the Bureau of Consular and Immigration Services) dates back to the early 1970’s when, among its other interactions with the Service, it succeeded in protecting the rights of a business in New York City to continue its operations despite the actions of the Service that threatened its client with serious financial losses and possibly closure. New York Pathological and X-Ray Laboratories, Inc., performed serology and x-ray examinations for people seeking lawful permanent residence in the United States. After more than twenty-five years of such work, during which time its test results were submitted to INS routinely and often at the Service’s request, INS issued a restrictive list of laboratories whose tests would be acceptable thereafter. N.Y. X-Ray was not on the list. Mr. Carroll challenged the Service’s actions on the grounds that INS instituted a licensing requirement without notice of its standards and without giving N.Y. X-Ray an opportunity to qualify for the license. The Second Circuit Court of Appeals agreed with the arguments made on behalf of Mr. Carroll’s client, overruled a Federal District Court and ordered that N.Y. X-Ray be permitted to resume submitting its results to INS. As a result, one owner of the business was able to restore 80% of his income, lost on account of the Service’s action.
